These Terms of Service (the “Terms”) govern your access to and use of the website located at www.the-numbers.com and all data, statistics, charts, rankings, and other content made available through it (collectively, the “Site”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Acceptance of These Terms

These Terms form a binding agreement between you and The Numbers. They apply to every visitor, user, and automated agent that accesses the Site. We may update these Terms from time to time; when we do, we will revise the “Last updated” date shown at the top of this document. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.

2. Ownership of Content and Intellectual Property

The Site, including its underlying data compilation, organization, structure, presentation, design, text, graphics, and software, is owned by Nash Information Services, LLC (“Nash Information Services”, operating as The Numbers) and is protected by United States and international copyright, database, and other intellectual property laws.

While individual facts (such as a film’s release date or reported box office figure) may not themselves be protectable, the selection, arrangement, and compilation of those facts into the datasets, rankings, and presentations on the Site represents substantial investment and creative effort, and is the proprietary property of Nash Information Services, LLC. All trademarks, logos, and service marks displayed on the Site remain the property of their respective owners.

3. Permitted Personal Use

Individual, private users are welcome to read, view, and copy information from the Site for their own personal, non-commercial use. This includes copying and pasting figures or passages for private reference, study, or casual sharing among individuals.

This permission does not extend to any commercial purpose, to systematic copying, or to any activity that would amount to redistribution or resale as described in Section 5.

4. Automated Access, Scraping, and Bots

Automated collection of data from the Site is restricted. The following rules apply to all bots, crawlers, spiders, scripts, and other automated agents:

4.1 General prohibition on scraping. Scraping, automated data collection, harvesting, and spidering of the Site are prohibited, except as expressly permitted in Sections 4.2 and 4.3.

4.2 Search-engine exception. Automated collection of content for the sole purpose of indexing the Site for a publicly available web search engine is permitted, provided the agent complies with the bot identification requirement in Section 4.4.

4.3 AI and machine-learning training. Automated collection of data from the Site to compile, build, or supplement datasets used to train, fine-tune, or develop artificial intelligence or machine-learning models is permitted only with our prior written permission. To request permission, contact us at support@the-numbers.com before commencing any such collection. Crawling for AI training purposes without having first received written authorization is a violation of these Terms.

4.4 Bot identification requirement. Any automated bot or crawler that accesses the Site must identify itself with a User-Agent string that includes the word “bot”. A bot whose User-Agent does not contain the word “bot” is in violation of these Terms, regardless of its purpose.

5. No Redistribution or Resale

Except for the personal use permitted in Section 3, you may not redistribute, republish, syndicate, sell, license, sublicense, or otherwise make available any data from the Site, in whole or in part. This restriction applies regardless of format or medium, including print, electronic files, databases, spreadsheets, APIs, feeds, screenshots, and any other means of reproduction or transmission.

6. Commercial and Academic Data Licensing

If you wish to use data from the Site for commercial purposes or for academic research, a license is available and required through our OpusData data service. Visit https://www.opusdata.com/ or direct licensing inquiries to sales@opusdata.com.

7. Press and Media Assistance

We are happy to help journalists and members of the press. If you are working on an article and need assistance compiling data, please email support@the-numbers.com and our team will do our best to help. Use of any data we provide remains subject to these Terms unless we agree otherwise in writing.

8. Acceptable Use

You agree not to:

  • Access the Site through any automated means except as permitted in Section 4;
  • Interfere with, disrupt, or place an unreasonable load on the Site’s infrastructure, servers, or networks;
  • Attempt to gain unauthorized access to any portion of the Site, its accounts, or its systems;
  • Circumvent, disable, or interfere with security or access-control features of the Site; or
  • Use the Site in any manner that violates applicable law or these Terms.

9. Disclaimer of Warranties

The Site and all data are provided on an “as is” and “as available” basis. We compile our data on a best-effort basis and strive for accuracy, but box office figures, estimates, forecasts, and other statistics are drawn from many sources and may contain errors, omissions, or revisions.

To the fullest extent permitted by law, The Numbers disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, completeness, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure. You rely on the data at your own risk.

10. Limitation of Liability

To the fullest extent permitted by law, The Numbers and its owners, officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of, or inability to use, the Site or its data — whether based on warranty, contract, tort, or any other legal theory, and even if we have been advised of the possibility of such damages.

In no event will our total aggregate liability for all claims relating to the Site exceed one hundred U.S. dollars (US$100). Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.

11. Governing Law and Venue

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to the personal jurisdiction of those courts.

12. Changes to These Terms

We may revise these Terms at any time by posting an updated version on the Site. Material changes take effect when posted, and the “Last updated” date will reflect the most recent revision. We encourage you to review these Terms periodically.
